Terms of Use

These terms are the agreement between you and Mihnea-Andrei Serbanescu, an individual developer based in Romania ("Detour", "we", "us"), for using the Detour app and service. They also serve as the end-user licence agreement (EULA) for the app. By creating an account you agree to them, so please read them. They are written to be readable, and the parts that matter most are in bold.
1. The short version
- Detour is for people 16 and over.
- Be kind, keep it legal, and keep yourself safe on quests. A quest is a suggestion, never a reason to take a risk.
- There is no tolerance for objectionable content or abusive behaviour. That includes nudity, sexual content, harassment, hate, violence and anything illegal. We remove it and ban the people who post it.
- You own your photos. You let us store them and show them to your party so Detour can work.
- Detour is free and provided "as is". We'll do our best, but we can't promise it will always be available.
2. Who can use Detour
You must be at least 16 years old and able to agree to these terms. You may not use Detour if we have previously banned you, or if the law forbids you from using it.
3. Your account
- Give accurate information when you sign up, and keep your password to yourself. You are responsible for what happens on your account.
- One person, one account. Don't impersonate anyone, and don't choose a username or display name that is offensive or misleading.
- Tell us at support@detourapp.eu if you think someone else has access to your account.
- You can delete your account at any time in the app (profile → delete account).
4. How Detour works
You join or create a party with friends using an invite code. Detour drops one quest at a time for your party. Members can accept it, go and do it, and post a proof photo with an optional caption. Your party sees each other's proofs once they've posted their own, or once the quest closes. Party members vote on whether a proof is legit, and points ("XP"), levels and streaks follow from that. The party owner can remove members and change the invite code.
XP, levels, streaks and titles are just for fun. They have no monetary value and can't be exchanged or transferred.
5. Quests happen in the real world: your safety comes first
Quests are light-hearted suggestions. You decide whether, when and how to do them, and you do them at your own risk. When you do a quest:
- Never put yourself or anyone else in danger. Skip any quest, or any part of one, that would be unsafe for you given the weather, the time, your health, traffic, heights, water or anything else.
- Obey the law and local rules. Don't trespass, don't enter places that are closed or off-limits, and follow traffic rules. Never use your phone while driving or cycling.
- Respect other people and their privacy. Don't photograph strangers in a way that intrudes on their privacy, and don't post photos of people who haven't agreed to it where that matters. Never photograph children who aren't yours or with their parents' permission.
- Respect property and nature. Leave places as you found them.
- Peer pressure is meant to be gentle. Never pressure a friend into doing something unsafe, and "not today" is always a fine answer.
We write quests to be safe and doable, but we can't know your circumstances or the conditions where you are. You are responsible for your own judgement.
6. Your content
"Content" means anything you post on Detour: proof photos, captions, profile photo, party names and covers, report notes and support messages.
- You keep ownership of your content.
- So that Detour can work, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process (for example resize and strip metadata), and show your content to the people it's meant for: your party members, and the Detour team where needed for moderation and support. This licence is only for running and improving the service. It ends when your content is deleted, except for copies we must keep by law or which remain for a short time in backups.
- We don't use your photos for advertising, sell them, or show them outside your party.
- You confirm that you have the right to post your content, and that it doesn't infringe anyone's rights, including copyright and privacy rights.
7. Rules for content and behaviour
Everything you post and do on Detour must follow our Community Guidelines. In particular, you must not:
- post nudity, sexual content, or anything that sexualises minors. That last one is reported to the authorities, see our Child Safety Standards;
- harass, bully, threaten, humiliate or intimidate anyone;
- post hateful content attacking people for who they are;
- post graphic violence, or promote self-harm or dangerous acts;
- post content showing or encouraging illegal activity;
- post someone's private information, or photos that invade their privacy;
- spam, scam, or impersonate others;
- interfere with Detour's operation: no hacking, scraping, overloading, reverse engineering beyond what the law allows, bypassing the reveal lock or security measures, or making automated accounts.
There is zero tolerance for objectionable content or abusive users.
8. Reporting, blocking and moderation
- You can report any proof photo or any person from within the app. Reports go to the Detour team, not to your party, and the person reported isn't told who reported them.
- You can block someone. Their photos, captions and map pins are hidden from you, and you won't get notifications about them.
- We review reports and act on objectionable content within 24 hours. When several people report the same photo, it is hidden from the party automatically until we've looked at it.
- We may remove any content, and warn, suspend or permanently ban any account, that we reasonably believe breaks these terms or the Community Guidelines, or that puts others at risk. Where appropriate we'll tell you what happened and why, and you can reply through help & support if you think we made a mistake.
- We are not obliged to monitor everything posted, but we act on what we find and what is reported to us.
9. Our licence to you
Subject to these terms, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use the Detour app on devices you own or control, for your own non-commercial use. Detour, its name, logo, design, quests and software belong to us or our licensors. These terms don't give you any rights to them except this licence.
10. Changes and availability
Detour is under active development. We may add, change or remove features, change the quest catalogue, or stop offering Detour altogether. If we plan to shut Detour down, we'll try to give you at least 30 days' notice. We may also temporarily suspend the service, for example for maintenance or security.
11. Ending your use
- You can stop using Detour and delete your account whenever you like.
- We may suspend or end your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other users. Except in urgent cases, for example illegal content or a risk to someone's safety, we'll explain why.
- Sections that by their nature should survive termination still apply after your account ends, including 6 (for content already shared), 12, 13 and 15.
12. Disclaimer
Detour is provided free of charge, "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, or that content posted by other users is accurate or appropriate. Other users' content is their responsibility, not ours.
Nothing in these terms limits rights you have as a consumer that cannot be limited by contract under the law of the country you live in.
13. Limitation of liability
To the extent the law allows, we are not liable for:
- loss or damage caused by your participation in a quest or other real-world activity, except where caused by our intent or gross negligence;
- content posted by other users, or their behaviour on or off Detour;
- indirect or consequential loss, or loss of data, profits or opportunity;
- interruptions or failures caused by events beyond our reasonable control.
Because Detour is free, our total liability to you for any claim is limited to EUR 100, to the extent the law allows.
None of this limits or excludes liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence, or any other liability that cannot be limited or excluded by law.

15. Law and disputes
These terms are governed by Romanian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. Please contact us first at {{CONTACT_EMAIL}}; most problems can be solved quickly that way. If not, disputes go to the competent courts of Romania. As a consumer in the EU you may also bring a claim in the courts of the country where you live.
16. Changes to these terms
We may update these terms, for example when Detour changes or the law requires it. We'll update the date at the top. For significant changes we'll tell you in the app or by email at least 15 days in advance, unless the change is legally required or needed urgently for safety. If you keep using Detour after a change takes effect, the new terms apply. If you don't agree, you can delete your account.
17. Apple App Store
If you downloaded Detour from Apple's App Store, the following also applies:
- These terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may also be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- We, not Apple, are solely responsible for providing any maintenance and support for the app. Apple has no obligation to provide any maintenance or support.
- To the extent any warranty applies by law, if the app fails to conform to it, you may notify Apple, and Apple will refund any purchase price (Detour is free). To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent not excluded by these terms.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- If a third party claims that the app or your possession or use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Our contact details for questions, complaints or claims about the app are in section 18.
- You must comply with applicable third-party terms of agreement when using the app, for example your mobile network's terms.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
